Upazila Parishad Act, 1998

Legislation enacted for the establishment of a local government organization named Upazila Parishad

As per the Article 59 of the constitution, according to the elected representatives of the local council called Upazila Parishad

It is expedient and necessary to provide for establishment of institutions and related matters;

Therefore, the following legislation has been enacted as follows:

1. Short title and commencement.- (1) This Act shall be called the Upazila Parishad Act, 1998.

(2) The Government shall, by notification in the official Gazette, determine the date.

2. Definition.- In this Act, unless there is anything repugnant in the subject or context,

1 [(a) "Temporary Chairman" means the person acting in the absence of the Chairman;]

(B) "union representative" means the chairman of the Union Parishad or the person acting on his duty referred to in section 6 (c);

(C) "Upazila" means any upazila declared under section 3;

(D) "tax" shall include any such rate, toll, fees, or any other similar amount imposed or amended under this Act;

(E) "Chairman" means the Chairman of the Council;

(F) "schedule" means any schedule of this act;

(G) "Council" means the upazila parishad constituted in accordance with the provisions of this Act;

(H) "regulation" means the regulations made under this Act;

(J) "municipal representative" means a mayor of municipality mentioned in clause (d) of sub-section (1) of section 6; or a person acting on his duty temporarily;]

(K) "rules" means the rules made under this Act;

3 [(l) "Vice Chairman" means the Vice Chairman of the Council;

(D) "female member" means the woman member selected in the constituency of the council mentioned in clause (e) of sub-section (1) of section 6;

(N) "Member" means Chairman of the Council, Vice Chairman and any other member;]

3. Declaration of Upazila. (1) Hereby the area mentioned in the third column of the schedule is declared as the upazila of the name mentioned in that column.

(2) After the enactment of this Act, the Government may, by notification in the official Gazette, declare a new upazila including a specific area.

4. Declaration of administrative section.- For the purpose of the purpose of Article 59, read with the paragraph 152 (1) of the Constitution, every Upazila declared under section 3 is hereby declared as administrative part of the Republic.

5. Establishment of Upazila Parishad.- (1) After the implementation of this Act, as soon as possible, in every upazila, an upazila council shall be established in accordance with the provisions of this Act.

1. Section 3 (i) of 2009 is substituted instead of clause (a) of section 3 (a).

Section 3 (b) of 22009 is substituted instead of clause (j) of section 3 (b) of the Act.

Section 3 (c) of 32009 is replaced by clause (l), (d) and (n) instead of clause (l) and (d) of section 3.

2. The council shall be a statutory body and its permanent continuity and a common seal shall be

Subject to law and regulations, it shall be entitled to acquire, possess, and transfer both movable and immovable movable property, and may file a case against it or it may be filed against it.

1 [6. Constitution of the council.- (1) According to the provisions of this Act, the upazila parishad shall consist of the following persons, namely-

(A) Chairman;

(B) Two vice-chairmen, of whom one shall be a woman;

(C) Chairman of every Union Parishad or a person acting as a chairman temporarily in the area under the upazila;

(D) every municipality, if any, in the area of ​​the upazila, its mayor or temporarily a person who performs the mayor's duties; And

(E) Female members of reserved seats according to sub-section (4)

(2) The Chairman and Vice Chairpersons referred to in sub-section (1) shall be elected directly by the voters in the electoral rolls made by the Election Commission, by secret ballot in time, place and manner determined by the Election Commission.

(3) No union council or municipality under the control of any upazila will be a member of the Upazila Parishad under clause (c) and (d) of sub-section (1), and the validity of the formation of the upazila council will not be inadequate if there is no such member.

(4) In case of Union Parishads and municipalities, if any, according to the number of seats of one-third of the total number of seats in each upazila, then reserved for women, mentioned as reserved seats, shall be reserved for women, who are the union councils and municipalities, if any Members or councilors will be elected from among them

Provided that nothing in this section shall release the right to directly elect a woman directly in reserved seats.

Explanation: In the prescribed number of seats reserved under this sub-section, if there is a fraction of that number and the fraction is half or more; But it must be treated as a whole number and if the fraction of the fraction is less than half, then it will be neglected.
